Please join us for the virtual CLE presentation On Child Hearsay presented by Judge Salomone. 

When one parent seeks to restrain, restrict, or limit the other party’s parenting time based upon an allegation of child abuse; there becomes a question of whether, and how, the child’s outcry statements can be admitted into evidence. This is a workshop for DR attorneys about the child hearsay statute, C.R.S. 13-25-129, which governs admissibility of a child’s statements regarding acts of abuse. The presentation is expected to be particularly useful for those attorneys who litigate TPO’s, PPO’s, and Motions to Restrict (or Modify) Parenting Time. This presentation is a primer that introduces the child hearsay statute, how it works, and the procedures required for admission of evidence under it. Practice tips will also be discussed, including considerations regarding how the statute does or does not replace the need for a CFI / PRE investigation or in camera interview of the child.
