Title: The Colorado Surrogacy Act: Requirements, Jurisdictional Considerations, Pitfalls, and What to Know as a Practitioner.
With the use of Assisted Reproduction Technology (“ART”) in family planning in the United States there has also been a surge in the popularity of surrogacy. Colorado adopted the Surrogacy Act in 2021, which outlines requirements in Colorado for the preparation of a Surrogacy Agreement. However, each state has their own legal authority which overlaps and interconnects depending on the location of the surrogate, the intended parents, the implantation, and the birth of the child. There are also specific considerations one should be aware of while preparing an Agreement and provisions that should be included in each practitioner’s Agreement.
This CLE program will introduce participants to the Colorado Surrogacy Act, the requirements under the Act, how to address and handle a matter with multiple jurisdictions, what provisions should be contemplated as part of the Agreement, and potential pitfalls and issues that may arise when representing a surrogate, donor, or intending parents. Further, we will also discuss what implications of Colorado’s passing of the 2024 Donor-Conceived Persons and Families of Donor-Conceived Persons Protection Act has on surrogacy agreements and donor agreements.
