ABA Formal Ethics Opinion 518 has prompted sharply differing reactions within the mediation community. Some view the opinion as a significant shift that will reshape mediator communications and usher in a new era of ethical clarity, while others see it as largely reaffirming long-standing principles. This program examines the opinion’s core requirements, the ethical rules it interprets, and the range of perspectives on its practical impact. Through examples and discussion, participants will explore what Opinion 518 means—and does not mean—for lawyers serving as mediators.
About the presenter:
Jennifer Sullivan brings more than twenty years of mediation experience to her work as a neutral, educator, and public servant. She teaches mediation at the University of Colorado Law School and serves as Deputy Attorney General for the State of Colorado. A former partner at the firm now known as Faegre Drinker Biddle & Reath and a former federal judicial law clerk, Jennifer also served on the board of the Center for Understanding in Conflict (CUC), a nonprofit focused on mediation training, and completed its teacher training program. She is a member of the executive council of the ADR Section of the Colorado Bar Association and is active in advancing the practice of mediation across the state.
